1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of the DigiPet mobile application and related services operated by DIGIIDS GLOBAL DIGITAL IDENTIFICATION INC. (“DIGIIDS,” “we,” “us,” or “our”).
By creating an account or using DigiPet, you agree to these Terms and acknowledge the DigiPet Privacy Policy. If you do not agree, do not create an account or use DigiPet.
2. Eligibility
You must be at least 13 years old to use DigiPet.
You must also have the legal capacity and appropriate authority to agree to these Terms and to provide the information you enter into DigiPet. If you use DigiPet for an organization or on behalf of another person, you represent that you have authority to do so.
Additional eligibility or consent requirements may apply where you live. You are responsible for complying with those requirements.
3. Account Responsibility
You must provide accurate account information and keep supported account information current.
You are responsible for providing an accurate email address that you can access. DigiPet may use your email address for account-related functions, including account verification, password reset, Shared Access invitations, and other necessary transactional account communications. DigiPet may require email verification for some users or account actions.
You are responsible for activity you authorize or permit through your DigiPet account and for taking reasonable steps to protect the account from unauthorized access.
You are also responsible for:
- Protecting your password, email account, devices, and exported materials;
- Preventing unauthorized access to your account; and
- Promptly notifying us if you believe your account has been accessed or used without authorization.
Do not share your password or other login credentials with another person. If you want another person to access supported pet information, use DigiPet's Shared Access feature where available.
4. User-Provided Information
DigiPet organizes and displays information provided by users. We do not independently verify that information.
You are responsible for the accuracy, completeness, legality, and appropriateness of information you add, including:
- Pet identity and profile information, such as pet name, species, breed, date of birth, color, and identification numbers;
- Pet photos;
- Health, medical, and care information;
- Medications, dosage information, and medication schedules;
- Scheduled doses and dose-completion history;
- Vaccination information;
- Veterinary visits and appointment information;
- Dates, times, recurrence details, and reminder settings;
- Weight and weight history;
- Microchip and insurance information;
- Veterinary clinic or hospital information;
- Owner, co-owner, and emergency-contact information; and
- Information selected for public profiles, Pet ID documents, DigiPet Passport documents, Medical History PDFs, other generated or exported documents, or Apple Wallet passes.
You must have the rights, permissions, or authority necessary to provide and use content submitted to DigiPet, including personal information about another person.
You remain responsible for checking and correcting your records. A display, reminder, document, pass, or notification generated from incorrect or outdated information may also be incorrect or outdated.
5. No Veterinary or Medical Advice
DigiPet is an organizational, recordkeeping, reminder, sharing, and pet-identification tool.
DigiPet is not a veterinarian or healthcare provider. It does not diagnose, treat, prescribe medication, determine dosage, assess symptoms, or provide veterinary, medical, emergency, or other professional advice.
Information, schedules, reminders, notifications, documents, passes, and records displayed or generated by DigiPet are not a substitute for advice, diagnosis, or treatment from a qualified veterinarian or other appropriate professional.
Always consult an appropriate professional concerning your pet’s health, medication, treatment, and care.
6. Emergencies
Do not rely on DigiPet for emergencies.
If an animal or person may be in immediate danger, contact a veterinarian, emergency veterinary hospital, poison-control service, or local emergency service as appropriate. Do not wait for a DigiPet reminder, notification, public-profile response, or support response.
7. Reminders and Notifications
DigiPet may provide reminders or notifications relating to medications, vaccinations, veterinary visits, and other user-entered events.
Notifications are a convenience feature. They may be delayed, blocked by device or operating-system settings, affected by network or platform availability, not delivered, or duplicated in exceptional circumstances.
You remain responsible for:
- Verifying all dates, times, schedules, and recurrence settings;
- Administering medications correctly and on time;
- Attending appointments and completing other pet-care tasks;
- Maintaining any additional reminder system appropriate for your pet; and
- Following instructions from your veterinarian.
DigiPet must not be your sole reminder system for medication, appointments, emergencies, or other time-sensitive or critical care. DigiPet reminders and notifications do not guarantee medication, treatment, vaccination, appointment, or care compliance.
8. Shared Access
DigiPet may allow an account owner to invite another person to access the owner's DigiPet workspace through Shared Access.
An invited person must use the intended DigiPet account and email address when accepting a Shared Access invitation. An invitation may fail or be unavailable if it is expired, revoked, intended for a different email address, or otherwise invalid.
A person with Shared Access may view and manage pet information available within the shared workspace according to DigiPet permissions. Changes made within a shared workspace may be visible to the owner and other authorized users.
The owner may remove another person's Shared Access. A person with Shared Access may also leave Shared Access. Removal or departure terminates future private access to that shared workspace, but it does not delete the owner's account, pets, pet records, documents, passes, or other workspace information.
Information previously downloaded, exported, saved, emailed, screenshotted, printed, added to Apple Wallet, or otherwise copied may remain outside DigiPet's control after Shared Access is removed or left.
9. QR Codes and Public Sharing
DigiPet may allow you to enable a public pet profile and select supported information for display through a QR code or public link.
You are responsible for reviewing your visibility settings and the selected information before enabling, displaying, printing, or sharing a QR code or public link.
Anyone with access to an enabled QR code or public link may be able to view the information you make public. That person may photograph, copy, download, print, or further share the information.
Disabling public sharing prevents future access through the active DigiPet public-profile feature, but DigiPet cannot retrieve or control copies already accessed or shared by another person.
Do not publish information that you do not want made public.
10. PDFs, Documents, Exports, and Apple Wallet
DigiPet may generate Pet ID documents, DigiPet Passport documents, Medical History PDFs, Apple Wallet pet ID passes, and other pet documents or exports as convenience features.
Generated documents, exports, and passes reflect information stored in DigiPet at the time they are generated. They may become outdated after information in DigiPet changes.
You are responsible for reviewing and verifying all generated information before using, exporting, printing, saving, adding to Apple Wallet, emailing, or sharing it.
Unless an appropriate veterinary clinic, authority, or other recipient independently accepts a generated item as such:
- A DigiPet document is not an official veterinary record, certificate, prescription, proof of ownership, travel document, or government identification; and
- An Apple Wallet pet ID pass is not official identification.
Availability, compatibility, and acceptance of Apple Wallet or a generated document are not guaranteed. Apple or another platform provider may change or discontinue relevant functionality.
Exported, printed, shared, emailed, downloaded, screenshotted, or wallet-stored copies may continue to exist outside DigiPet after account deletion, Shared Access removal, Shared Access departure, or data updates. Updating or deleting an app record does not automatically update, retrieve, or erase copies outside DigiPet.
11. Acceptable Use
You may not:
- Use DigiPet for an unlawful, fraudulent, harmful, or misleading purpose;
- Impersonate another person or misrepresent your authority;
- Submit content you do not have permission to use;
- Violate another person’s privacy, intellectual-property, or other legal rights;
- Attempt to gain unauthorized access to an account, system, or record;
- Bypass or interfere with authentication, authorization, rate limits, or security controls;
- Probe, scan, or test DigiPet for vulnerabilities without written authorization;
- Introduce malicious code or interfere with service operation;
- Scrape, harvest, or systematically extract information from DigiPet except where expressly authorized;
- Use public-profile features to harass, threaten, defraud, or endanger another person; or
- Use DigiPet in a manner that unreasonably burdens or damages the service.
12. Third-Party Services
DigiPet relies on third-party services for functions such as database hosting, photo hosting, transactional email, push notifications, Apple Wallet, operating-system integration, static website hosting, and app distribution.
Third-party services may have their own terms, privacy practices, availability, and technical requirements. Their services may change, be interrupted, or become unavailable.
To the maximum extent permitted by applicable law, we are not responsible for third-party products or services that we do not control. This provision does not limit rights or remedies that cannot legally be limited.
13. Intellectual Property
DigiPet’s software, design, branding, interfaces, original content, and related intellectual property are owned by DIGIIDS or its licensors and are protected by applicable laws.
Subject to these Terms, DIGIIDS grants you a limited, personal, revocable, non-exclusive, non-transferable licence to use DigiPet for its intended purpose.
Except as permitted by law or with our written authorization, you may not copy, modify, distribute, sell, lease, reverse engineer, create derivative works from, or commercially exploit DigiPet or its proprietary content.
You retain ownership of content you provide, subject to the limited licence below.
14. Licence for User Content
You grant DIGIIDS a limited, non-exclusive licence to host, store, reproduce, process, format, display, and transmit your content only as reasonably necessary to:
- Operate and secure DigiPet;
- Provide features you request;
- Operate Shared Access according to owner invitations, accepted access, removals, and departures;
- Generate reminders, documents, exports, and Apple Wallet passes;
- Display information according to your QR and public-sharing choices;
- Maintain backups and service reliability; and
- Comply with applicable legal obligations.
This licence does not transfer ownership of your content to DIGIIDS.
The licence ends when the content and related account records are deleted, except to the extent temporary copies remain in backups or provider systems, the content has been exported or shared outside DigiPet, or continued retention is required or permitted by applicable law.
15. Service Availability and Changes
We may maintain, update, modify, limit, suspend, or discontinue all or part of DigiPet.
We do not guarantee that every feature will always be available, uninterrupted, compatible with every device, or offered indefinitely. Features may depend on service providers, network access, app-store requirements, notification workers, platform permissions, or operating-system support.
Where reasonably practicable, we may provide notice of a material change or discontinuation. We are not required to maintain a particular feature solely because it was previously available.
You are responsible for keeping any separate records or copies that you reasonably need for your pet’s care.
16. Account Deletion
You may permanently delete your account through Security & Privacy > Delete Account. You must be authenticated and provide your current password.
Deletion removes, disables, or revokes applicable DigiPet-controlled account information and related application records as appropriate, which may include account records, owned workspaces, pet records, health and care records, medication and dose records, weight records, notification information, device registrations, memberships, Shared Access invitations, Wallet download tokens, and related active-service data.
Deletion is subject to the retention, provider, backup, legal, operational, and external-copy limitations described in the Privacy Policy.
Deleting your account does not automatically remove PDFs, printed copies, public-profile copies, screenshots, emails, downloaded files, Apple Wallet passes, or other copies already stored or shared outside DigiPet.
17. Suspension and Termination
We may restrict, suspend, or terminate access when reasonably necessary to:
- Address unlawful use;
- Protect DigiPet, users, or others from a security or safety risk;
- Respond to a serious or repeated violation of these Terms;
- Comply with a legal requirement; or
- Protect the integrity or availability of the service.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct the issue. Immediate action may be necessary for urgent security, safety, abuse, or legal concerns.
Terms that by their nature should continue after account deletion or termination—including intellectual-property, disclaimer, liability, and governing-law provisions—will continue to apply.
18. Warranty Disclaimer
To the maximum extent permitted by applicable law, DigiPet is provided on an “as is” and “as available” basis.
We do not guarantee that DigiPet will be uninterrupted, error-free, secure against all risks, compatible with every device, or that reminders and notifications will be delivered. We do not guarantee that user-provided information or generated documents will be accurate, complete, current, or accepted by a veterinarian, authority, platform, or other person.
You are responsible for verifying information and obtaining appropriate professional veterinary advice.
Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot legally be excluded.
19. Limitation of Liability
To the maximum extent permitted by applicable law, DIGIIDS and its directors, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, revenue, or profits arising from or related to DigiPet.
To the maximum extent permitted by applicable law, DIGIIDS is not responsible for loss or harm resulting from:
- Inaccurate, incomplete, or outdated user-provided information;
- Veterinary, medication, dosage, treatment, or emergency decisions;
- A delayed, missed, blocked, or duplicated notification;
- Reliance on DigiPet as a sole reminder system;
- A lost animal or unsuccessful identification effort;
- Information a user chose to make public;
- Copies made after public, shared, or exported information was accessed or shared;
- Shared Access granted, used, removed, or left by authorized users;
- A generated PDF, document, export, or Apple Wallet pass;
- Device loss or unauthorized device access;
- Third-party services or platform availability; or
- Service interruption, modification, or discontinuation.
These limitations apply only to the extent permitted by applicable law. Nothing in these Terms limits liability or consumer rights that cannot legally be waived or limited.
20. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
This section does not prevent the application of mandatory rights or protections that apply to you under applicable law.
21. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
These Terms and the DigiPet Privacy Policy constitute the agreement between you and DIGIIDS concerning your use of DigiPet, except where additional terms are expressly presented for a particular feature.
A failure to enforce a provision is not a waiver of that provision.
22. Changes to These Terms
We may update these Terms as DigiPet, applicable requirements, or our services change. We will publish updated Terms in DigiPet and at https://digiids.com/terms-of-use and update the effective date. Where required by applicable law, we will provide additional notice or obtain consent.
Your continued use of DigiPet after updated Terms take effect constitutes acceptance where permitted by applicable law. If you do not agree to updated Terms, you must stop using DigiPet and may delete your account.
